Obviously you don't have to be DQed, since timing gates are allowed. But here it was the competitor's mistake *and* there no way to generate a time. So DQ is inevitable and acceptable.
The misplaced control is more troublesome. Generally, you don't automatically void a race for a small misplaced control (where I take "small" to mean, if you're in the right place, you can see the flag). You also have to consider whether it had any effect on the race.
Here, Kris' winning margin is far more than any time loss there, but 2nd and 3rd places depend on the leg. And that matters because the rules say the purpose of the event is to allow everyone to race, not to determine the winner.
Good old rule 6.1 applies "The spirit of fairness and good fellowship is to be the guiding principle...". Fairness implies voiding, good fellowship probably means not voiding.
I'm not a fan of fairness, so I'd let the result stand, and thank little Hoddy for being a good fellow.
