8. What does a Club need to provide British Orienteering?

As per the 2010 AGM, Clubs need to submit an Annual Return to the National Office by the 1st November. To comply with the AGM proposal, Clubs needs to:

Pay the British Orienteering Affiliation Fee of £46.00 (£9.20 Student Clubs).

Be administered by a Committee that consists of a minimum of 3 people.

Notify British Orienteering of the names of at least 3 Officers, typically Chair, Secretary, Treasurer who may form the minimum number required as the club committee.

Have a constitution and return a copy to the National Office.

Take responsibility for the maintenance of correct financial records.

These shall be audited or examined annually, by a person that is independent of the committee and not related to a committee member. These accounts must be presented annually at a Club AGM and approved by club members. The minutes of the AGM should be returned to the National Office.

BOF articles say:
30. Categories of Membership
30.1 The categories of membership are specified within the Rules of the Company in Article 51.
30.2 In addition to its Members, the Company shall recognise the following classes of groups and individuals:
30.2.1 Constituent Associations, being the self-governing National, Regional and Other Associations which are recognised by the Company.
30.2.2 Affiliated Clubs, being Orienteering Clubs registered with the Company as having paid the appropriate club affiliation fee for the current year.

Those are the old articles, the new articles say:

30. Categories of Membership
30.1 The categories of membership are specified within the Company Rules in Article 51.
30.2 In addition to its members, the Company shall recognise the following:
30.2.1 Constituent Associations, named within the Company Rules in Article 51.7.
30.2.2 Affiliated Clubs, being Orienteering Clubs registered with the Company as
having paid the appropriate club affiliation fee for the current year and any
further requirements as determined at general meeting.

34.2.1 to receive from the Board the Company's accounts;
34.2.2 to receive from the Board a report of the activities of the Company since the
previous annual general meeting;
34.2.3 to appoint the Company's auditors;
34.2.4 to decide the annual subscriptions and affiliation fees
34.2.5 to transact such other business as may be legitimately brought before it;
34.2.6 to appoint (as appropriate) the President, and Vice-President(s); and
34.2.7 to elect the elected directors in place of those retiring.

The proposal at the AGM was for Senior and Junior membership fees. Where was the club affiliation fee proposal?

I don't have a copy of the 2011 AGM booklet to hand, but the proposals setting fees/levies are normally worded to apply "from 1st January XXXX until amended" - ie. if the fees aren't explicitly changed at a GM, they continue at the current level. This wording is to cover (a) the fees staying at the current level, in which case there is no requirement to vote on them, and (b) what to do if a motion to change the fees is defeated.

The motion at the 2012 AGM didn't change the club affiliation fee, so the 2012 fee (as set at the 2011 AGM) will continue to apply in 2013. But I agree that it might have been better to have made this clear in the supporting statement for the proposal.

Er no, my version was taken from the "Articles of Association" dated April 2012 as presented as the first item in the list of Governance Documents on the Governance/Documents page of the BOF website

Whereas your version is drawn from the "Proposed Articles And Association" (sic) marked "proposed April 2012" listed further down the same page with other documents relating to the AGM proposal

I'll leave it someone from BOF to clarify why the final articles differ from those voted on...

Yes, it does say something like that.

As you say it wasn't clear. It means that the figures I have used to produce comparisons of amounts ESOC paid/will pay to British Orienteering via levies and affiliation fee is incorrect. For a club our size it doesn't have that big an impact, but smaller clubs may have miscalculated.

I believe that the version of the Articles that smf is looking at is the correct version as voted on at the AGM - cf the AGM booklet. The version that greywolf is looking at looks to me like a much earlier draft that has been uploaded by mistake - compare the two very different version of article 28, for instance. I'll check with the office and see if we can get this replaced with the correct version.

I think you meant Affiliation fee although to some (many?) Affliction fee is closer.
